MiniByte Marketing Terms and Conditions
All MiniByte Marketing clients agree to comply with the terms and conditions as outlined below:
MiniByte Marketing (MiniByte) is a Trade Name wholly owned and operated by American Name Services, Inc., a Utah Corporation. The MiniByte packages provide marketers with an inexpensive and easy to use solution for their prospect lead generation and nurturing needs.
Clients are the users of the MiniByte Marketing Packages
Prospects are the targeted sales leads that have yet to be contacted
Marketing Packages may include all or some of the following components: Industry specific and targeted sales lead contact information including: Name, Address, Phone and Email address; A Template-driven Postcard and Email generation interface; Up to 6 X 9 Postcard quality Paper, printing, postage, email deployment and email tracking services
Billable Transaction is the purchase of the marketing package
Client understands that no guarantees concerning the effectiveness or performance of the data or marketing packages has been made by MiniByte.
Data Package - Client agrees that once the sales lead data file has been received from MiniByte, it is to be utilized for the purposes of direct marketing as it relates to the clients known business and will not be utilized for other reasons.
Premium and Platinum Postcard and Email Packages - In addition to the Data Package conditions, client also understands and agrees that the one-time deployment of the Postcard and Email marketing campaigns are dependent upon the final approval of Artwork by the client and the agreed upon delivery dates for deployment.
The client is responsible for the completion of the Postcard and email creation as outlined on the website.
The email data will not become the ownership of the client until such time that the prospect has responded to the clients offer.
MiniByte has been designed and developed in accordance with appropriate specifications and industry standards. MiniByte does not warrant the uninterrupted or error-free operation of its platform. MiniByte has taken the necessary steps to ensure that any unexpected technical difficulties will not negatively impact Client’s consumer experiences.
MiniByte will not be liable for any failure in performance where such failure is occasioned by an act of God. |
